2. Flight Bookings
PDEM do not offer any flight booking service. Please check all flight services in and out of either Cairns Domestic or International Airports to ensure your flight times “marry-up” with our eclipse packages.
3. Reservation Confirmation
Eclipse package reservations will only be confirmed once full monies are paid. Your booking will be held for 7 days after the initial deposit to allow flight arrangement to be confirmed.
If flights are confirmed at time of inital booking full monies can be paid and festival reservation confirmed.
4. Deposit Payments
To make an booking of an eclipse package a 50% fully refundable initial deposit must be paid to hold your booking.
5. Final Payments
Once flight arrangements have been confirmed the final 50% of package payments must be made within 7 days after initial booking to confirm their reservation.
6. Refund / Cancellation Policy
Initial deposits are fully re-fundable less a $100 administration fee prior to the confirmation of flights 7 days after the initial booking. All payments are strictly non-refundable after that time. An exception is possible where application is made for full refund and PDEM consider the eclipse packages are over subscribed and agents and accommodation providers, service and tour operators will suffer no loss of income from a full refund less 10% administration fee.
7. Eclipse Package Prices
All package prices are represented in Australian dollars. All package prices are clearly displayed on the PDEM Eclipse Festival website. Please note carefully package prices are reflective of the number of guests sharing rooms or apartments.
8. Tour Alterations
Although it is not expected that any changes will be made to the eclipse packages there may be changes to tours, functions or the overall itinerary due to unforeseen circumstances. In all cases PDEM will make all efforts to provide guests with itineraries and tours to the original standard and price value should any unforeseen changes have to be made.
9. Transfers
All airport, event and tour transfers are included in the Solar Eclipse Festival Packages. Guests must be ready at the specified time and location for transfer pick up. Failure to present on time will result in additional costs for individual transfers.
10. Accommodation Options
A number of accommodation options are presented as part of the Solar Eclipse Festival Packages. These options are fully outlined and described on the Total Eclipse Festival website. Specific requests may be made regarding accommodation options, but these may incur additional expense or be unavailable.
11. Additional Accommodation Services
Guests are responsible for any additional expenses such as in-room dining or bar purchases. Room rates are strictly room only unless specified.
12. Additional Persons
There is no provision for additional persons in rooms unless by agreement with PDEM and approval by the accommodation provider. In the case where additional persons are approved there will be additional accommodation costs.
13. Children / Families
The Total Eclipse Festival Packages are suitable for children and families. Please be aware that in the majority of cases children of the age of 14 and above will be charged an adult price for all tours, functions and events. No child discounts are available on accommodation. Where child prices are required we ask that you contact the PDEM office by email to outline the particular package enquiry.
14. Taxes
The Total Eclipse festival packages do not include any departure or airport taxes. Australian Government Goods and Services Tax (gst) is included in all tour price information.
15. Gratuities / Payments
Tipping or paying gratuities is not a normal practice in Australia.
16. Insurance
No travel insurance is included in any of the PDEM Total Eclipse Festival Packages. PDEM recommend all guests take up comprehensive travel insurance.
17. Luggage
Weather conditions in Far North Queensland in November allow guests to travel light. No heavy clothes will be needed and dress is always casual. Guests need to maintain close security over any valuables and especially expensive eclipse viewing equipment. Please check carefully baggage weight allowances for all legs of your tour.
18. Inclusions / Exclusions
Tour inclusions are strictly as detailed on the Total Eclipse website and include transfers, accommodation, tours, events and functions. Meals are included with tours and functions only when specified.
No flights are included in tours and any flight changes are not the responsibility of PDEM. All passport, visas and travel documents are also the responsibility of each individual guest.
PDEM have secured the best possible vantage points for the viewing of the total solar eclipse, but cannot guarantee weather conditions on the morning of the eclipse which may have a detrimental effect on the viewing locations.
19. Tour Changes
Over the period in the lead-up to the total solar eclipse there may be opportunities to improve the tours, events or general conditions of the Solar Eclipse Festival. In this case and with due consideration PDEM may make alterations to the tour itinerary and notify all guests via email of these changed conditions.
20. Disclaimer
Port Douglas Event Management (PDEM) act only in the capacity of agent for the suppliers of the services named in the packages or otherwise providing services or goods in connection with the packages, such as hotels and resorts, cruise boats, tour operators, bus lines, restaurants, and providers of entertainment.
We assume no responsibility for any personal injury, property damage, or other loss, accident, delay, inconvenience, or irregularity which may be occasioned either by reason (1) any act or omission of any of the suppliers (2) any matter beyond our exclusive control including but not limited to a delay or cancellation of a flight that causes you to miss any portion of the packages provided. We have no special knowledge regarding the financial condition of the suppliers, unsafe conditions, health hazards, weather hazards, or climate extremes at locations to which you may travel. You assume full and complete responsibility for checking and verifying all passport and visa requirements of the destinations and for complying with all laws of the country in the Itinerary. You are also responsible for respecting the authority and following the directions of the guide during the trip. We may exclude you from participating in all or any part of the trip if, in our sole discretion, your condition or behavior renders you unfit for the trip or unfit for continuation once the trip has begun. Unfitness may include, without limitation, any behavior that, regardless of its cause, is inappropriate or offensive or interferes with the delivery of our services, or may constitute a hazard or embarrassment. In such case, our liability shall be strictly limited to a refund of the recoverable cost of any unused portion of the trip. Should you decide not to participate in certain parts of the trip, no refunds will be made for those unused parts of the trip. You agree to indemnify and hold us harmless from and against any costs, damages, losses, or liabilities arising out of your actions or omissions.
The right is reserved to withdraw any tour announced by PDEM or make substitutions and/or alterations as may be found desirable for the convenience of the parties and the proper carrying out of the tour. The tour price is per person and quoted in AUST dollars. All rates are subject to change without prior notice due to unforeseen economic circumstances or currency fluctuations. Any increase in cost as a result of change in either will be borne by tour participant.
Any dispute related to the trip shall be governed by Queensland law without regard to conflict of laws principles. You agree to present any claims against us within 30 days after the trip ends and to file within one year of the incident, and you acknowledge that this expressly limits the applicable statute of limitations to one year. You agree to grant us (and third parties with whom we may engage in joint marketing) a worldwide, royalty-free, fully paid up license to use your photographic, video, or digital likeness solely for our promotional and/or commercial purposes. Facsimile transmission of any signed document shall be deemed delivery of an original. At our request, you shall promptly provide an original document as well. If there are any conflicts between these terms and conditions, the Reservation Form, and the Itinerary, these terms and conditions shall apply.
If for some reason a specific part of these terms and conditions is held to be void then only that part of the terms and conditions will be effected. All other parts of the terms and conditions shall remain in force.
Please note: Any payment for the 2012 Solar Eclipse Festival will be taken as an acceptance of these terms and conditions.
